Overview

Live Cam Recorder operates as a "Service Provider" under 17 U.S.C. § 512(k)(1) and qualifies for DMCA safe harbor protections. Live Cam Recorder does not, in any case, host video materials on its servers. It may store thumbnails and photos from automated processes using publicly available internet data.

Notice of Claimed Infringement

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please submit a notice containing all of the following elements:

  1. Authorization: An electronic or physical signature of the person authorized to act on behalf of the owner of the intellectual property rights.
  2. Description: A description of the copyrighted work that you claim has been infringed, including the specific URLs where the allegedly infringing material is located.
  3. Contact Information: Your address, telephone number, and email address.
  4. Good Faith Statement: A statement that you have a good faith belief that the disputed use is not authorised by the copyright owner, its agent, or the law.
  5. Sworn Accuracy: A statement made under penalty of perjury that the information in your notice is accurate and that you are the copyright owner or authorised to act on the copyright owner's behalf.

Abuse Notification

Abusing the DMCA notice procedures can result in legal liability for damages, court costs, and attorneys' fees under federal law pursuant to 17 U.S.C. § 512(f). This policy applies only to copyright infringement claims and does not address other legal matters.

Take Down Procedure

Upon receiving a valid notification of claimed infringement, Live Cam Recorder will expeditiously remove and/or disable access to the allegedly infringing material and notify the affected user. Live Cam Recorder reserves the right to terminate the accounts of repeat infringers. The affected user may then submit a counter-notification as described below.

DMCA Counter-Notification Procedure

If you believe that material you posted was removed or disabled by mistake or misidentification, you may submit a counter-notification containing all of the following elements:

  1. Material Description: Specific identification of the material that was removed or disabled and the location where it appeared before removal.
  2. Location Details: The URL or other specific location where the material appeared prior to removal.
  3. Error Statement: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  4. Contact Information: Your name, physical address, telephone number, and email address.
  5. Jurisdiction Consent: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Live Cam Recorder may be found.

Upon receipt of a valid counter-notification, Live Cam Recorder will replace the removed material within ten to fourteen (10–14) days unless the original claimant files a court action seeking an injunction against the restoration of the material.

Service Provider Customers or Subscribers

If the alleged infringer is operating as a service provider themselves, DMCA notices should be submitted to their designated DMCA agent rather than to Live Cam Recorder.

Modifications to Policy

Live Cam Recorder reserves the right to modify, alter, or add to this policy. All affected persons should check back regularly to stay current with any changes.
